1. Introduction
FiapPay ("we", "us", "our"), operated by Los Bebes Inc., is committed to protecting the privacy and security of your personal information. This Privacy Policy explains how we collect, use, store, share, and protect your data when you use our escrow platform for online commerce across social media (including WhatsApp, Instagram, TikTok, and Facebook), via Mobile Money (MTN MoMo and Orange Money). By using FiapPay, you consent to the practices described in this policy. It should be read together with our Terms of Service.
2. Information We Collect
Information you provide directly:
- Phone Number: your Mobile Money-registered phone number, used as your primary account identifier and for transaction processing.
- Account Holder Name: the name associated with your Mobile Money number, retrieved to confirm payout details.
- Transaction Details: bill amounts, item descriptions, buyer/seller numbers, and timestamps.
- Dispute Evidence: photos, videos, screenshots, shipping receipts, and descriptions you submit during a dispute.
- Communication Data: messages exchanged with the FiapPay bot, including commands and responses.
- KYC Information (when applicable): identity or business-verification documents you provide to unlock higher limits.
Information collected automatically:
- Transaction Metadata: timestamps, statuses, payment confirmation codes from Mobile Money networks, and escrow lifecycle events.
- Technical Information: basic metadata provided by the WhatsApp Business API.
Information we do NOT collect:
- Your Mobile Money PIN, passwords, or secret codes.
- Bank account details or credit/debit card numbers.
- Location data, contacts, or media from your device.
- Browsing history; this marketing website is static and does not use tracking cookies.
3. How We Use Your Information
- Transaction Processing: to create bills, process payments, manage escrow, generate Release PINs, and execute disbursements.
- Fraud Prevention: to detect and prevent fraudulent transactions, unusual patterns, and Terms violations.
- Dispute Resolution: to review evidence, mediate disputes, and issue binding determinations.
- Service Communication: to send confirmations, PINs, dispute updates, and notices via WhatsApp.
- Compliance: to meet KYC/AML obligations and respond to lawful requests.
- Improvement: to analyze anonymized, aggregated data to improve reliability, performance, and security.
We never sell, rent, or trade your personal data to third parties for marketing or advertising. Ever.
4. Legal Bases for Processing
We process your data where: it is necessary to perform our contract with you (executing transactions you request); it is necessary to comply with a legal or regulatory obligation (KYC/AML, retention, lawful requests); it serves our legitimate interests in preventing fraud and securing the Service, balanced against your rights; or you have given consent (which you may withdraw at any time, without affecting prior processing).
5. Data Sharing and Third Parties
We share data only with the following, and only as necessary to provide the Service:
- Payment Aggregator, TAKWID GROUP (CamPay): we share your phone number and transaction amounts with our licensed aggregator to process Mobile Money collection and disbursement. All debits and credits are carried out by TAKWID GROUP (CamPay), not by FiapPay or Los Bebes Inc. They operate under their own privacy policy and regulatory obligations.
- WhatsApp Business API (Meta): messages exchanged with the bot are subject to WhatsApp/Meta's Terms and Privacy Policy.
- Cloud Infrastructure Provider: transaction data is stored on encrypted cloud servers; data is encrypted in transit and at rest.
- Law Enforcement & Regulators: we may disclose data in response to valid legal requests, court orders, or where necessary to prevent fraud or financial crime, or to protect users' rights and safety.
We do not share your data with advertisers or data brokers.
6. International Data Transfers
Some of our service providers (such as cloud-infrastructure and messaging partners) may process data on servers located outside Cameroon. Where data is transferred internationally, we take reasonable steps to ensure it is protected by appropriate safeguards and handled consistently with this policy and applicable law.
7. Cookies & Website Analytics
This marketing website is static and does not set tracking or advertising cookies. We use a single browser localStorage entry solely to remember your language preference (English or French). The core FiapPay service operates within WhatsApp and does not rely on web cookies.
8. Data Security
- Encryption: all data transmissions between our systems and Mobile Money APIs are secured with TLS/SSL encryption.
- Signed Webhooks: payment notifications are cryptographically verified, so forged or tampered messages are rejected.
- PIN Security: Release PINs are stored only as secure hashes, never in plain text, and brute-force attempts trigger automatic lockouts.
- Access Controls: access to user data is limited to authorized personnel on a need-to-know basis.
- No MoMo PIN Access: we integrate only via official APIs and never request, store, or access your Mobile Money PIN.
While we take extensive precautions, no system is 100% secure. We cannot guarantee absolute security but are committed to promptly addressing any incident.
9. Data Retention
- Transaction Records: retained for a minimum of 5 years, as required by financial regulations and for audit.
- Dispute Evidence: retained for 2 years following resolution, then securely deleted.
- Communication Logs: bot conversation logs retained for 1 year for service quality and dispute reference.
- Inactive Accounts: after 24 consecutive months without activity, personal data may be archived and subsequently deleted, subject to retention requirements.
On expiry, data is securely deleted or anonymized so it can no longer be associated with you.
10. Your Rights
Subject to applicable Cameroonian law, you have the right to access, correct, delete, or restrict the processing of your personal data, and to object to certain processing or withdraw consent. Note that deleting your data terminates your ability to use FiapPay and does not affect completed transactions or data we must retain by law. 11. Automated Processing & Fraud Detection
To keep the Platform safe, we use automated checks, such as transaction-limit enforcement, daily-volume monitoring, and PIN brute-force lockouts, that may automatically pause, lock, or flag a transaction for human review. Where an automated action affects you, you may contact support to request a human review of the decision.
12. Children's Privacy
FiapPay is not intended for individuals under 18. We do not knowingly collect personal information from minors. If we discover we have inadvertently collected data from a person under 18, we will promptly delete it. If you believe a minor has used FiapPay, contact us immediately.
13. Data Breach Notification
In the unlikely event of a security breach that affects your personal data, we will investigate promptly, take steps to contain and remediate it, and notify affected users and any competent authority where required by applicable law, without undue delay.
14. Changes to This Policy
We may update this Privacy Policy to reflect changes in our practices, technology, or legal requirements. For material changes, we will notify users via the FiapPay bot and update the "Last Updated" date above. Continued use after changes constitutes acceptance. We encourage you to review this policy periodically.
